What is payday loan?

A payday loan (also called a payday advance, salary loan, payroll loan, small dollar loan, short term, or cash advance loan) is a small, short-term unsecured loan, "regardless of whether repayment of loans is linked to a borrower's payday."[1][2][3] The loans are also sometimes referred to as "cash advances," though that term can also refer to cash provided against a prearranged line of credit such as a credit card. Payday advance loans rely on the consumer having previous payroll and employment records. Legislation regarding payday loans varies widely between different countries and, within the USA, between different states.

To prevent usury (unreasonable and excessive rates of interest), some jurisdictions limit the annual percentage rate (APR) that any lender, including payday lenders, can charge. Some jurisdictions outlaw payday lending entirely, and some have very few restrictions on payday lenders. In the United States, the rates of these loans were formerly restricted in most states by the Uniform Small Loan Laws (USLL),[4][5] with 36%-40% APR generally the norm.

There are many different ways to calculate annual percentage rate of a loan. Depending on which method is used, the rate calculated may differ dramatically. E.g., for a $15 charge on a $100 14-day payday loan, it could be (from the borrower's perspective[6]) anywhere from 391% to 3733%.[7]

Although some have noted that these loans appear to carry substantial risk to the lender,[8][9] it has recently been shown that these loans carry no more long term risk for the lender than other forms of credit.[10][11][12] These studies seem to be confirmed by the SEC 10-K filings of at least one lender, who notes a charge-off rate of 3.2%.[13]


The loan process[edit]
The basic loan process involves a lender providing a short-term unsecured loan to be repaid at the borrower's next payday. Typically, some verification of employment or income is involved (via pay stubs and bank statements), although according to one source, some payday lenders do not verify income or run credit checks.[14] Individual companies and franchises have their own underwriting criteria.

In the traditional retail model, borrowers visit a payday lending store and secure a small cash loan, with payment due in full at the borrower's next paycheck. The borrower writes a postdated cheque to the lender in the full amount of the loan plus fees. On the maturity date, the borrower is expected to return to the store to repay the loan in person. If the borrower does not repay the loan in person, the lender may redeem the check. If the account is short on funds to cover the check, the borrower may now face a bounced check fee from their bank in addition to the costs of the loan, and the loan may incur additional fees or an increased interest rate (or both) as a result of the failure to pay.

In the more recent innovation of online payday loans, consumers complete the loan application online (or in some instances via fax, especially where documentation is required). The funds are then transferred by direct deposit to the borrower's account, and the loan repayment and/or the finance charge is electronically withdrawn on the borrower's next payday.


User demographics and reasons for borrowing[edit]
According to a study by The Pew Charitable Trusts, "Most payday loan borrowers are white, female, and are 25 to 44 years old. However, after controlling for other characteristics, there are five groups that have higher odds of having used a payday loan: those without a four-year college degree; home renters; African Americans; those earning below $40,000 annually; and those who are separated or divorced." Most borrowers use payday loans to cover ordinary living expenses over the course of months, not unexpected emergencies over the course of weeks. The average borrower is indebted about five months of the year.[15]

This reinforces the findings of the Federal Deposit Insurance Corporation (FDIC) study from 2011 which found black and Hispanic families, recent immigrants, and single parents were more likely to use payday loans. In addition, their reasons for using these products were not as suggested by the payday industry for one time expenses, but to meet normal recurring obligations.[16]

Research for the Illinois Department of Financial and Professional Regulation found that a majority of Illinois payday loan borrowers earn $30,000 or less per year. [4] Texas' Office of the Consumer Credit Commissioner collected data on 2012 payday loan usage, and found that refinances accounted for $2.01 billion in loan volume, compared with $1.08 billion in initial loan volume. The report did not include information about annual indebtedness.[17] A letter to the editor from an industry expert argued that other studies have found that consumers fare better when payday loans are available to them.[18] Pew's reports have focused on how payday lending can be improved, but have not assessed whether consumers fare better with or without access to high-interest loans. Pew's demographic analysis was based on a random-digit-dialing (RDD) survey of 33,576 people, including 1,855 payday loan borrowers.[5]

In another study, by Gregory Elliehausen, Division of Research of the Federal Reserve System and Financial Services Research Program at The GWU School of Business, 41% earn between $25,000 and $50,000, and 39% report incomes of $40,000 or more. 18% have an income below $25,000.[19]

In 2014 American Express sponsored a short film entitled Spent: Looking for Change which chronicles the experiences of several people with payday and auto title loans. American Express offers several low cost pre-paid cards of their own, while most payday lenders issue loan on pre-paid cards with significant transnational fees.

On the HBO program Last Week Tonight with John Oliver, a segment was devoted to payday lending.[20]

Draining money from low-income communities[edit]
The likelihood that a family will use a payday loan increases if they are unbanked, or lack access to a traditional deposit bank account. In an American context the families who will use a payday loan are disproportionately either of black or Hispanic descent, recent immigrants, and/or under-educated.[16] These individuals are least able to secure normal, lower-interest-rate forms of credit. Since payday lending operations charge higher interest-rates than traditional banks, they have the effect of depleting the assets of low-income communities.[21] The Insight Center, a consumer advocacy group, reported in 2013 that payday lending cost U.S communities $774 million a year.[22]

A report from the Federal Reserve Bank of New York concluded that, "We...test whether payday lending fits our definition of predatory. We find that in states with higher payday loan limits, less educated households and households with uncertain income are less likely to be denied credit, but are not more likely to miss a debt payment. Absent higher delinquency, the extra credit from payday lenders does not fit our definition of predatory."[23] The caveat to this is that with a term of under 30 days there are no payments, and the lender is more than willing to roll the loan over at the end of the period upon payment of another fee. The report goes on to note that payday loans are extremely expensive, and borrowers who take a payday loan are at a disadvantage in comparison to the lender, a reversal of the normal consumer lending information asymmetry, where the lender must underwrite the loan to assess creditworthiness.

A recent law journal note summarized the justifications for regulating payday lending. The summary notes that while it is difficult to quantify the impact on specific consumers, there are external parties who are clearly affected by the decision of a borrower to get a payday loan. Most directly impacted are the holders of other low interest debt from the same borrower, which now is less likely to be paid off since the limited income is first used to pay the fee associated with the payday loan. The external costs of this product can be expanded to include the businesses that are not patronized by the cash-strapped payday customer to the children and family who are left with fewer resources than before the loan. The external costs alone, forced on people given no choice in the matter, may be enough justification for stronger regulation even assuming that the borrower himself understood the full implications of the decision to seek a payday loan.[24]

Aggressive UK advertising practices[edit]
In May 2008 the debt charity Credit Action made a complaint to the UK Office of Fair Trading (OFT) that payday lenders were placing advertising on the social network website Facebook, which violates advertising regulations. The main complaint was that the APR was either not displayed at all or not displayed prominently enough, which is clearly required by UK advertising standards.[25][26]

Aggressive collection practices[edit]
In US law, a payday lender can use only the same industry standard collection practices used to collect other debts, specifically standards listed under the Fair Debt Collection Practices Act. The FDCPA prohibits debt collectors from using abusive, unfair, and deceptive practices to collect from debtors. Such practices include calling before 8 o'clock in the morning or after 9 o'clock at night, or calling debtors at work.[27]

In many cases, borrowers write a post-dated check (check with a future date) to the lender; if the borrowers don't have enough money in their account, their check will bounce.

Payday lenders will attempt to collect on the consumer's obligation first by simply requesting payment. If internal collection fails, some payday lenders may outsource the debt collection, or sell the debt to a third party.

A small percentage of payday lenders have, in the past, threatened delinquent borrowers with criminal prosecution for check fraud.[28] This practice is illegal in many jurisdictions and has been denounced by the CFSA, the industry's trade association.

Pricing structure of payday loans[edit]
The payday lending industry argues that conventional interest rates for lower dollar amounts and shorter terms would not be profitable. For example, a $100 one-week loan, at a 20% APR (compounded weekly) would generate only 38 cents of interest, which would fail to match loan processing costs. Research shows that on average, payday loan prices moved upward, and that such moves were "consistent with implicit collusion facilitated by price focal points".[29]

Consumer advocates and other experts argue, however, that payday loans appear to exist in a classic market failure. In a perfect market of competing sellers and buyers seeking to trade in a rational manner, pricing fluctuates based on the capacity of the market. Payday lenders have no incentive to price their loans competitively since loans are not capable of being patented. Thus, if a lender chooses to innovate and reduce cost to borrowers in order to secure a larger share of the market the competing lenders will instantly do the same, negating the effect. For this reason, among others, all lenders in the payday marketplace charge at or very near the maximum fees and rates allowed by local law.[24]

Boy With Brain Tumor Ashya King to Get Specialized Treatment in Prague

LONDON — The parents of a five-year-old British cancer patient — who sparked an international manhunt when they took him out of the hospital against doctors' advice — claim their son has been cured of a brain tumor.

Ashya King's parents were arrested in August after they removed him from a U.K. hospital against doctors' wishes to pursue proton beam therapy — an alternative to radiotherapy — abroad in Prague. Proton beam therapy is is not covered by Britain's National Health Service (NHS).

Brett King and his wife Neghemeh told Britain's the Sun newspaper that scans now show their son is cancer-free.




"It's incredible news. We are absolutely delighted," Brett King said in an interview published Monday. "It has justified everything we have gone through because things are working out for Ashya. If we had left Ashya with the NHS we don't think he would have survived. We have saved his life."

The Kings' story made international headlines last year after the parents were tracked down and arrested in Spain. They said they were planning to sell their second home there to pay for the treatment in Prague.

The 5-year-old boy with a brain tumor, who was taken by his parents from a British hospital against advice of his doctors, was admitted to a hospital in Prague on Monday in preparation for the specialized therapy that he was denied in the U.K. Ashya King was admitted to the University Hospital in Motol, about 15 miles from the Proton Therapy Center, where he is expected to begin proton beam radiation therapy within the week, according to a hospital statement. Ashya has a "highly malignant tumor, and our oncologists must have assurance that the tumor does not grow or metastasize again," before he can receive proton radiation, the hospital's oncology director, Dr. Jan Starý, said.













Ashya's parents — Brett King, 51, and Neghemeh King, 45 — were briefly arrested in late August after fleeing with their son to Spain, sparking a Europe-wide manhunt. When the Kings were released, they said they took their son from University Hospital Southampton in England because doctors there would not treat their son with the proton radiation. University Hospital Southampton said in a statement that there was "no benefit to Ashya of proton radiotherapy over standard radiotherapy," but the Proton Therapy Center said the treatment is proven to prolong life expectancy and increase the quality of life for patients like Ashya.

The 5-year-old boy with a brain tumor taken out of a U.K. hospital against the advice of his doctors — sparking an international manhunt for him and his parents — is expected to arrive next week in Prague for specialized treatment, the Proton Therapy Center said in a statement Sunday. Experts will convene at 8 a.m. Monday for a final meeting about the boy’s condition, and then he will be flown from the hospital in Spain where he is currently being treated.

Police pursued Ashya's parents — Brett King, 51, and Neghemeh King, 45 — last week when they plucked their son from University Hospital Southampton in England. When the Kings were found with the boy in Spain, they said they took their son because they were seeking a facility that would treat him with proton beam radiation therapy, The Associated Press reported. University Hospital denied him the treatment because doctors determined there was "no benefit to Ashya of proton radiotherapy over standard radiotherapy," according to a statement.

“We just want to help our son get through this bad time because he hasn't got too many months to live,” Brett King said Wednesday after charges brought against he and his wife — stemming from the incident — were dropped. Ashya's parents said they will sell property in Spain to pay for the proton beam radiation therapy, which the Proton Therapy Center said can begin once the young boy undergoes preparatory chemotherapy.

Viagra and Drug Interactions

If you are taking a nitrate drug, such as nitroglycerin (Nitrostat) or isosorbide dinitrate (Dilatrate-SR) for chest pain or heart problems, do not take Viagra, as the interaction with sildenafil can cause a sudden and dangerous drop in blood pressure.
Be aware that some recreational drugs, such as amyl nitrate or nitrite ("poppers") contain nitrates. Blood pressure can drop when Viagra is taken with alpha-blockers.

Viagra and Grapefruit

Viagra (Sildenafil Citrate)

Viagra (Sildenafil citrate) is a drug used to treat erectile dysfunction (impotence) in males and pulmonary arterial hypertension (PAH).
Background
The pharmaceutical company, Pfizer, originally developed Viagra. In 1006, the FDA approved Viagra as the first drug patented for use of erectile dysfunction in the United States.  They are blue, diamond-shaped pills with “Pfizer” marked on one side and “VGR XX.” The XX is the dosage, which is either 25,50, or 100 mgs.  Viagra is also sold under the brand name Revatio and generically under various other names.  It is also widely availabe by many research companies and underground labs.
Action

Viagra treats erectile dys function and works by relaxing muscles and increases blood flow to particular areas of the body (in this case, the penis, specifically).  Its effects last up to four hours.  The most common side effects of Viagra are headache, facial flushing, and upset stomach. Rarely, blurred vision, or sensitivity to light may briefly occur.
As well as treating impotence, Sildenafil Citrate can also be effective in treating Pulmonary Arterial Hypertension (PAH).  Similarly to how it acts to relax muscles of the penis, it relaxes arterial walls; therefore, reducing resistance and pressure in the arteries.
Sildenafil Citrate is solely active in relaxing muscles and increasing blood flow to the heart, lungs and penis due to PDE-5, yet vasodilation is not increased in other parts of the body.
Technical Data
In studies where Viagra was administered to over 3700 patients, 19-87 years old in world wide clinical trials. More than 550 patients received treatment post 1 year.  2.5% of the Viagra subjects and 2.3% of the placebo subjects reported adverse effects, which were all considered mild.  These reported side effects included abnormal or blurred vision and increased sensitivity to light (1).  All other negative reactions reported, including URI, flu symptoms, back pain and arthralgia, occurred at a rate of less than 2% and equally common in the placebo and Viagra administered groups (1).  Effects worsened and were reported more frequently as dosages increased (1).
Other studies measured duration of sexually stimulated erection using a Rigiscan device.  Duration of rigidity was increased by 60% with Viagra use (2).
In 16 separate 4-24 week trials of men (over 18 years old) who suffered from impotence for longer than 6 months, dosages between 10-200 mgs were administered (3).  Significant improvements in erectile function, including frequency of penetration as well as erection duration post penetration, were reported with Sildenfil treatment compared to the placebo group (4). Erections were improved in 72% of the Viagra group verses 18% of the placebo group (5).  In all cases effects were dependant upon dosage and improvement was the greatest when dosage exceeded 100 mgs (6).  Responses were decreased by 40-60% in patients suffering from diabetes and prostatectomy, respectively (7)(8).  Withdrawal rates were less than 5% related to negative side effects and limited response rates (9).
